ACCEPTABLE USE POLICY

This Acceptable Use Policy (“Policy”) sets out the acceptable and unacceptable uses of this website and any related services provided by Klue to its customers (the “Services”). This Policy is automatically incorporated into and will form part of the applicable agreement for Services (“Agreement”) between Klue and the Klue customer acquiring Services. This Policy applies to Klue customers and their users (or their affiliates or other entities’ users, as applicable) that are entitled to use and access the Services pursuant to the Agreement (collectively, “Customers” or “Customer”).

  1. Customer may not use nor permit use of the Services to upload, copy, collect, transmit, store, use, distribute, or otherwise process any information, data, text, software, code, scripts, music, sound, photos, graphics, videos, messages, tags, interactive features, or other materials that:

    1. contains personal data other than personal data in relation to which Customer has consent or permission from the owner thereof or other lawful right;
    2. contains any special categories of personal data or sensitive data (as defined in applicable laws, or any regulated personal data (including sensitive Personal Data, such as financial information, payment card numbers, social insurance or security numbers, and health information);
    3. infringes or misappropriates a third party’s intellectual property or proprietary rights, including any copyright, trademark, patent, trade secret, moral rights, or any other intellectual property right or proprietary or contractual right;
    4. is invasive of a person's privacy or otherwise violates a person’s legal rights (such as rights of privacy and/or publicity);
    5. is tortious, defamatory, obscene, offensive, hate-related or violent, or advocates discrimination against individuals or groups;
    6. contains viruses, bots, worms, scripting exploits, or other similar materials; or
    7. violates, encourages, or furthers conduct that would violate any applicable laws, including any criminal laws, or any third-party rights.
  2. Customer may not use nor permit use of the Services:

    1. to license, sublicense, sell, resell, rent, lease, transfer, assign, or otherwise make the Services available to any third party, other than to its users, or as otherwise expressly permitted pursuant to the Agreement;
    2. to knowingly send, store, publish, post, upload or otherwise transmit any viruses, Trojan horses, worms, time bombs, corrupted files or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any systems, data, Personal Data or property of another;
    3. in a manner that severely disrupts the integrity or performance of the Services;
    4. to attempt to hack or gain unauthorized access to the Services or related systems or networks including using or knowingly permitting the use of any security testing tools in order to probe, scan or attempt to penetrate or ascertain the security of the Services or related systems or networks;
    5. to copy, create a derivative work of, reverse engineer, reverse assemble, disassemble, or decompile the Services or any part thereof or otherwise attempt to discover any source code or modify the Services, except as expressly provided for in the Agreement; or
    6. to authorize, permit, enable, induce or encourage any third party to do any of the above.

Klue may update this Policy from time to time by posting changes to Klue’s website. Except as otherwise specified by Klue, updates will be effective upon the date indicated at the top of this page. The updated version of the Policy will supersede all prior versions.
